Urge your MI state legislators to support these new bills introduced to regulate data centers!

Recent bills in the MI State House and Senate were introduced to regulate data centers in Michigan – Senate bills 0761, 0762, and 0763 and House bills 5396, 5397, and 5398. Contact your state legislators to encourage them to support these legislative efforts!

Senate Bill 761 (Bayer – Novi-D) would bar entities withdrawing above an average of 2,000,000 gallons of water per day for consumptive use – where the water is lost and is not returned to the system – from obtaining a water withdrawal permit.

Senate Bill 762 (Shink – Ann Arbor-D) would create transparency standards on how much water and energy these facilities use, by requiring the Michigan Public Service Commission to publish annual reports regarding the total energy expenditures and water usage of data centers.

Senate Bill 763 (Geiss – Taylor-D) would bar water utilities from passing off the infrastructure costs to accommodate a data center onto residential customers.

Additionally, three legislators introduced bills to repeal the 2024 law granting sales tax exemptions to data centers. The bills (House bills 5396, 5397, and 5398), sponsored by Representatives Jim DeSana (R-Carleton), Erin Byrnes (D-Dearborn), and Dylan Wegela (D-Graden City), were referred to the House Economic Competitiveness Committee.
